Endorsement of the Agreement
You acknowledge that you have read and understood the following Terms and Conditions (collectively the “Terms”), including terms of our Privacy Policy available at www.aklaktaza.com.
You acknowledge that these Terms constitute a binding and enforceable legal contract between yourself and YMJ Solutions (hereinafter referred to as “Aklak Taza”, “Company”, “we”, “us” , “our”) with reference to the use of this Platform. Please read these terms before ordering any items from our application.
You become a user of the Platform (“User” or “you”), by entering, using, browsing or registering on the Platform. As a User, you agree and undertake to comply with the provisions of these Terms.
By viewing, using, accessing, browsing, or submitting any content or material on the Platform, you agree to these Terms as a binding legal agreement, without limitation or qualification. The term "you" or "You" shall include any person or entity, who views, uses, accesses, browses or submits any content or material to the Platform.
If you do not agree to these Terms, then you may not use the Platform. Aklak Taza reserves the right to modify these Terms at any time without prior notice. You agree that each visit you make to the Platform shall be subject to the Terms as displayed, and your continued use of the Platform now or following the modifications in these Terms confirms that you have read, accepted, and agreed to be bound by such modifications.
Our Services
The Platform connects Users who agree to the Terms with partnered kitchens, chefs and other providers that may be operated by third parties or affiliated companies (hereinafter referred to as the “Merchants”).
The purpose of this Platform is to offer a simple and convenient service, linking Users to local Merchants for delivery (our “Service”) of various goods, including prepared meals, beverages, non-prepared food, and miscellaneous non-food items (hereinafter collectively referred to as “Goods”).
Users can easily build and submit orders with just a click. When you place an order from a Merchant, Aklak Taza acts as a facilitator on behalf of that Merchant to process your order and manage your experience throughout the order process. This Platform is created to serve as a marketplace for its Users.
Aklak Taza does not sell or interfere in any way in the production of any goods or service produced by the Merchants. It provides Users with the ability to search for and find local Merchants that deliver or make these Goods available for delivery to their addresses.
Merchants are required to comply with local laws, rules, regulations, and standards related to the preparation, sale, marketing, and safety of goods and services. However, Users should understand that Aklak Taza does not independently verify the credentials, representations, or products of Merchants, including the ingredients or quality of any products, or their compliance with applicable laws.
Aklak Taza does not guarantee the quality of any Goods or their compliance with applicable laws, nor does it guarantee that the Goods listed on the Platform will match what is actually provided to Users. Merchants may claim that their goods and services meet specific standards, such as "organic," "macrobiotic," or allergen-specific standards like "nut-free," "gluten-free," or "lactose-free." However, Aklak Taza is not required to provide ingredient or allergen information on the Platform and does not guarantee that the Goods sold by Merchants are free of allergens, unless required by law. If you have allergies, allergic reactions, or dietary restrictions, please mention in the comments directly before placing an order. Aklak Taza does not independently verify such claims.
Aklak Taza and the Merchants (as the case may be) will make reasonable efforts to comply with your special instructions for an order. However, if this is not feasible, possible, or commercially reasonable, Aklak Taza and/or the Merchants reserve the right to prepare the order according to standard procedures. Neither Aklak Taza nor the Merchants are responsible for replacing or refunding an order that does not meet special instructions provided by you.
Aklak Taza is not liable for any goods or services offered by Merchants that are unhealthy, cause injury, are otherwise unacceptable, or do not meet Users' expectations.
Users are responsible for verifying the accuracy of delivery addresses, and Aklak Taza is not liable for any errors in addresses. All goods and services preparation and readiness for delivery are the sole responsibility of the Merchant accepting the order. While Merchants will do their best to meet specified delivery times, factors beyond their control may cause delays, and delivery times cannot be guaranteed. We will inform you of any unexpected delays as soon as we become aware of them.
Creating an Account for the Platform
Users can create an account on the Platform by choosing their own unique “username” and “password.” The username is personal and cannot be shared by multiple Users. The password is known only to the User and can be changed at any time. Users are responsible for selecting and protecting their passwords. Aklak Taza is not liable for any issues arising from password use. Users will be informed about local promotions via email. Aklak Taza may share your username and password with third-party companies to provide our Service, such as sharing your phone number with Merchants for faster and accurate delivery. To access services requiring an account, Users must log in with their username and password.
By using this Platform, you confirm that any personal information you provide is true, accurate, current, and complete. You must notify us immediately of any changes to your personal information by updating your User profile on the Platform or by contacting us. You agree not to impersonate any other person or entity or use a false name or a name you are not authorized to use.
Users are not allowed to register multiple accounts for the same person. Violating this rule may result in account termination. You are responsible for all activities and orders placed through your account. If you suspect someone knows your password, contact us immediately.
You may not use the Platform for any unlawful or unauthorized purposes, including but not limited to:
• Distributing unlawful, libelous, abusive, threatening, harmful, obscene, or otherwise objectionable material.
• Transmitting material that constitutes a criminal offense, results in civil liability, or breaches any laws, regulations, or codes of practice.
• Interfering with others' use or enjoyment of the Platform.
• Damaging, disabling, or impairing the operation of the Platform or attempting unauthorized access to the Platform or connected networks through hacking, spoofing, or similar means.
If you wish to delete your Account, please contact us via the Platform chat feature requesting the same.
How to Place an Order and How It Works
1. Selecting Goods: Browse the list of available Goods from your chosen Merchant and make your selections.
2. Submitting Your Order: Once you've selected your items, click on the “Checkout” button to submit your order (the “Order”).
o Important: Double-check all the information you enter and correct any errors before clicking “Checkout,” as you won't be able to make changes afterward.
3. Order Processing: After you submit your order, the Platform will start processing it. You will receive a confirmation email and a message on the final page indicating that your order has been successfully received and sent to the Merchant.
4. Payment Authorization: If your payment is not authorized, you will be redirected to the previous page on the Platform, and we will not be obligated to provide the services.
Order Cancellation
1. Cancelling Before Acceptance: You can cancel an order for a full refund until the Merchant accepts it.
2. Cancelling After Acceptance: If you need to cancel an order after it has been accepted by the Merchant, please contact us via the chat function on the Platform. Aklak Taza reserves the right to not issue full or partial refunds for cancellations made after the order has been accepted.
3. Merchant Cancellations: A Merchant may cancel an order even after you have received a confirmation. Both Aklak Taza and our partner Merchants reserve the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.
4. Order History and Refunds: Your order history will only display successful orders. In case of a failed online payment, the order amount will be refunded to your Aklak Taza account as credit, unless you request a refund to the original payment method, which will take 7-14 days depending on your bank.
Delivery
The availability of goods offered by Aklak Taza may vary depending on your delivery area. By entering your delivery address on the Platform, you will see the Merchants available to you at that time. Delivery areas may expand, shrink, or change due to various conditions such as weather, traffic, or force majeure events.
Delivery Time
Aklak Taza will deliver your order to the address you provide. You will receive an estimated delivery time in your email confirmation and on the order tracking page. However, delivery times may vary due to factors beyond our control, such as order quantity, distance, time of day (peak periods), weather conditions, and traffic. You can check the remaining delivery time of your order by clicking on ‘My Orders’ on the Platform. Please note that the delivery time provided is only an estimate, and orders may arrive earlier or later. To ensure you do not miss a delivery, please make sure that you or someone else is available at the delivery location to receive the order once it is placed.
Unsuccessful or Failed Deliveries
Without prejudice to any other clauses in these Terms, if we attempt to deliver an order but are unable to do so due to reasons caused by you, including but not limited to:
• No one being present or available to receive the order.
• The customer being uncontactable despite attempts to reach them via the provided phone number.
• Lack of appropriate or sufficient access to deliver the order successfully.
• Lack of a suitable or secure location to leave the order.
We will contact you via in-app call, message, or email to inform you of the unsuccessful delivery and the next steps. In such cases, Aklak Taza reserves the right to cancel the order without refund or remedy to you.
No Show Cancellation
If you remain uncontactable or fail to receive the order within a reasonable time after it arrives at your delivery address, Aklak Taza reserves the right to cancel the order without refund or remedy to you.
Wrong Order, Missing Order, Defective Items
If you find any issues with your order upon receipt (e.g., wrong items, defective items, or missing items), please contact customer support immediately via our in-app chat feature. In some cases, Aklak Taza may request photographic proof and/or additional information to investigate the issue properly. If we determine that the order or goods you received are not of satisfactory condition or quality, we will compensate you for the affected parts of your order.
Late Delivery
If your order is significantly delayed beyond the estimated delivery time, please contact customer support immediately via our in-app chat feature. In some cases, Aklak Taza may request additional information to investigate the issue properly. If we determine that your order was significantly delayed, we will compensate you for it.
Your Responsibilities
When using the Platform's services, you agree to the following:
1. Accuracy of Information:
Ensure that the information you provide is correct. You are solely responsible for any losses resulting from misinformation or inadequate information (e.g., forgetting your password). Your account may be terminated in such cases.
2. Personal Responsibility:
You are responsible for all personal ideas, opinions, and statements you share while using the Platform, as well as any files you upload and personal information you send. Aklak Taza is not liable for these files. You must not access any services provided on the Platform in an unauthorized manner or alter the software in any way. You must indemnify Aklak Taza for any losses if you fail to comply with these terms. Aklak Taza is not responsible for any damages arising from unauthorized access to user data.
3. Conduct:
You must not send threatening, immoral, racially offensive, or illegal messages. All correspondences, titles, and nicknames must comply with public morality, good manners, and laws. You must not harass or threaten other users or Platform personnel, interfere with other users' services, or post, print, distribute, or circulate inappropriate or unlawful materials. You must not advertise, sell, or offer to sell any products or services, or engage in activities like surveys, competitions, or chain letters. You must not send harmful information or programs that could damage other users' computers.
4. Data Responsibility:
You are responsible for any damages, loss of information, or other losses caused by materials obtained through Aklak Taza's services. You cannot demand compensation for losses arising from using the service. You must not use the Platform for commercial or advertising purposes without Aklak Taza's consent. Aklak Taza may monitor all systems at any time.
5. Legal Compliance:
You must not send legally forbidden information or unauthorized emails like chain mail or malicious software. You must not record or misuse others' personal information. You are responsible for all actions taken under your username. Clients must pay the service fee at the time of product delivery; otherwise, the products will not be delivered.
6. Account Use:
You must not access the Platform or services using a third party's account without their consent. You must not use the Platform for illegal purposes or commit any acts of infringement. You must not engage in commercial activities apart from sanctioned use of Aklak Taza services. You must not copy content for republication or create reviews or blog entries for commercial purposes. You must not attempt unauthorized access to other computer systems or interfere with others' use of the Platform. You must not upload or transmit viruses or other harmful files or disrupt the Platform's security.
7. Minors:
Minors must have permission from and be supervised by a parent or guardian to use the Platform. If you are a minor, your parent or guardian must read and agree to this Agreement before you use the Platform.
8. Payment:
Credit or debit cards used for online payments must belong to the user. Otherwise, the user must have legal permission from the card owner to perform the transaction.
User Data
Except for personally identifiable information (“Personal Data”), which is covered under the Platform Privacy Policy, any material you transmit or post to this Platform will be considered non-confidential and non-proprietary. The Platform will have no obligations regarding such material. The Platform and its designees will be free to copy, disclose, distribute, incorporate, and otherwise use that material and all data, images, sounds, text, and other elements contained in it for any commercial or non-commercial purposes.
You are prohibited from posting, uploading, or transmitting to or from this Platform any material that:
• Breaches any applicable local, national, or international law.
• Is unlawful or fraudulent.
• Constitutes unauthorized advertising.
• Contains viruses or other harmful programs.
You must not misuse the Platform (including by hacking).
Any comments or feedback you submit through the Platform must not:
• Contain defamatory, obscene, or offensive material.
• Promote violence or discrimination.
• Infringe on the intellectual property rights of another person.
• Breach any legal duty owed to a third party (such as a duty of confidence).
• Promote illegal activity or invade another’s privacy.
• Give the impression that they originate from us.
• Be used to impersonate another person or misrepresent your affiliation with another person.
The prohibited acts listed above are non-exhaustive. You will compensate Aklak Taza for all costs and damages incurred as a result of you breaching any of these restrictions.
Aklak Taza will fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity or location of anyone posting material in breach of the above terms.
Acceptable Use Policy
General Use
• The Platform is for personal use only.
• Commercial use is only allowed if specifically endorsed or approved by the Platform.
• The company has the right to suspend, block, or terminate accounts for prohibited activities and prevent his access to log in the services.
Prohibited Activities include but not limited to the following:
1. Legal Violations
• Violating any law, statute, ordinance, or regulation.
• Violating laws or regulations regarding the sale of alcoholic drinks or prescription drugs and devices.
• Violating copyright, trademark, right of publicity or privacy, or any other proprietary right.
2. Illegal Products, Services and Activities
• Engaging in or promoting illegal products, services or activities.
• Payments to or from sanctioned countries or individuals involved in terrorism or financial crimes.
• Providing false information about identity or business activities.
• Products, services or activities finance terrorism.
• Selling narcotics, steroids, controlled substances, or products containing THC, CBD, or similar substances.
• Engaging in discriminatory, hateful, racist, or exploitative activities including media and journalism.
3. Financial and Payment Services
• Acting as a payment service provider without authorization.
• Involvement in ammunition, explosives, arms, defense, weapons or related parts or accessories.
• Services related to hospitality timeshares or travel visas.
• Unauthorized promotion or advertising of products or services.
• Collecting money without a required license.
• Multi-level marketing, network sales, inbound and outbound telemarketing, pyramid schemes, or similar programs.
• Gambling, betting, casinos, lotteries, and related activities or sale of value usable “chips” or vouchers connected to this services, certain in-purchasing games
• Offering get-rich-quick schemes or similar programs.
• Financial services like factoring, lending, investment, escrow, or mortgage services.
• Buying or selling stocks, bonds, securities, currency exchange or similar financial instruments.
4. Other Prohibited Activities
• Engaging in objectionable, offensive, or inappropriate behavior towards Aklak Taza personnel.
• Involvement with highly rated politically exposed persons (PEP).
Company Rights
• Investigate and remove content posted on the Platform that does not conform to these Terms.
• Remove content that is abusive, illegal, or disruptive that does not conform to these Terms.
Authority of Aklak Taza
System Operation
• Aklak Taza may temporarily suspend or completely cease system operations at any time.
• Aklak Taza is not responsible for any consequences to users or third parties due to suspension or cessation of operations.
User Accounts
• Usernames and passwords must be displayed and approved by registered users.
• Aklak Taza may prevent users from creating new passwords or using old passwords indefinitely if deemed necessary.
Service Quality
• Aklak Taza does not guarantee timely, secure, or complete service delivery; results obtained from services shall be correct or reliable. Also, service quality meet user expectations.
Data Management
• Aklak Taza has the right to back up and delete files and messages provided by users during the use of service.
• Aklak Taza is not responsible for backup and deletion processes.
Ownership and Copyrights
• Aklak Taza owns the copyrights to information, documents, software, designs, graphics, etc., produced by or purchased by the Platform.
Sales and Availability
• Sales are limited to the current availability of menus from merchants on Aklak Taza.
• Aklak Taza is not responsible for items ordered but not delivered by the merchant due to unavailability.
User-Generated Content
• Aklak Taza has the right to post, transmit, or relocate user-generated content, information, documents, software, designs, graphics, etc. (such as the messages, poets, reports/news, file posted to the bulletin board) within the Platform.
• Users cannot demand royalties for content copied or posted by other users.
Price and Product Information
• Companies with cyber merchants on Aklak Taza are responsible for updating price and product specifications.
• Aklak Taza may correct in the event of any misinformation by canceling orders.
Platform Transitions
• Aklak Taza may provide transitions for a user to other platforms and is not responsible for the content of those platforms.
Service Changes and Availability
• Aklak Taza may change services to require an account, provide additional services, change existing services partially or completely, or transform services into paid ones.
• The Platform may be unavailable at times for maintenance and upgrades.
• Aklak Taza will endeavor to notify users in advance of any service unavailibilty but this cannot guarantee.
Guidelines for Reviews
Approval Criteria
Relevancy
• Reviewers must have had a firsthand experience with the Merchant.
Acceptable Content
• Aklak Taza is not obligated to approve reviews on the Platform. Reviews may be rejected for reasons including, but not limited to:
o Offensive Language: Profanity, abusive, racist, and hate language are not tolerated.
o Irrelevant Content: Content that is not relevant or indicative.
o Discrimination: Based on religion, race, gender, national origin, age, marital status, or disability.
o Illegal Activity: References to illegal activities or uncorrelated references to society’s traditions and values.
o Conflicts of Interest: Competing Merchants are not allowed to post negative reviews. Violations may result in permanent removal from the Platform.
o Health Code Violations: Allegations of health code violations.
o Outdated Information: Information that is outdated or obsolete.
Not Endorsed
• Reviews are not endorsed by Aklak Taza and do not represent the views of Aklak Taza, its parent companies, or subsidiaries.
• Aklak Taza does not assume liability for any review or for any claims, liabilities, or losses resulting from the use of the Platform or information on the Platform.
Ownership
• Reviews are owned by Aklak Taza exclusively in perpetuity.
• Aklak Taza has the right to reproduce, modify, translate, transmit, and/or distribute all materials related to reviews.
• Aklak Taza is under no obligation to pay the author or anyone else for their reviews.
Termination of Agreement
Aklak Taza has the right to terminate, suspend, or delete your account and your access to or use of the Platform, including any delivery service we provide to you in respect of an order, for any reason. This includes, without limitation, if Aklak Taza, in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of these Terms. Where appropriate, Aklak Taza will give you the opportunity to state your position before any termination, suspension, or deletion of your account.
Restrictions for Non-Personal and Non-Commercial Use
You agree that the consequences of commercial use or re-publication of content or information from Aklak Taza may lead to serious and incalculable monetary compensation that may not be a sufficient or appropriate remedy. Aklak Taza will be entitled to temporary and permanent injunctive relief to prohibit such use.
Refund Policy
Aklak Taza takes user satisfaction very seriously. In the case of problems with your goods and services order, please contact Aklak Taza through our live chat, and we will assist you. In appropriate cases, if you have already been billed by Aklak Taza on behalf of the Merchant, Aklak Taza will issue full or partial refunds.
• Full Refund: If you did not receive your order.
• Partial Refund: If part of your order is missing.
We will take into account relevant factors, including the details of the order, and do our best to ensure your satisfaction. You will receive your refund as Aklak Taza credit on your Aklak Taza account unless you request a refund to the original source of payment.
Price and Payment
Order Agreement
• Once your order has been accepted, it represents an agreement between you (the User) and the Merchant.
• The Merchant has sole responsibility for fulfilling the order.
• Cash payments are made directly to the Merchant upon delivery.
Payment Services
• Aklak Taza does not provide any payment service to you or third parties.
• All online payments are processed via your own issuer/payment service provider and the payment service providers in partnership with Aklak Taza.
Pricing
• Prices quoted on the Platform are displayed in the country’s national currency and are subject to applicable tax.
• Prices and offers on the Platform may vary from those offered by Merchants elsewhere (including their own websites, mobile applications, or brick-and-mortar outlets).
• Prices and additional charges (including but not limited to Delivery, Small Basket, Service fees, or Cash on Delivery fees) indicated on the Platform are as at the time of each order and may be subject to change.
• Aklak Taza reserves the right to charge fees for services as deemed necessary for business.
• The breakdown of prices and additional charges is displayed before checkout.
• By placing an order, you agree to all amounts, additional charges, and the final 'Total' amount displayed to you.
Payment Methods
• When using your account as a payment instrument, you may choose from different payment methods available and indicated on the Platform.
• Aklak Taza reserves the right to offer additional payment methods and/or remove existing payment methods at any time at its sole discretion.
• If you choose to pay using an online payment method, the payment shall be processed by our third-party payment service provider(s).
• With your consent, your credit card/payment information will be stored with our third-party payment service provider(s) for future orders. Aklak Taza does not store your credit card or payment information.
• You must ensure that you have sufficient funds on your credit and debit card to fulfill payment of an order.
• Aklak Taza takes responsibility for payments made on our Platform, including refunds, chargebacks, cancellations, and dispute resolution, provided they are reasonable and justifiable and in accordance with these Terms.
• At the time of checkout, please read the applicable payment terms and disclaimers carefully before using any payment method.
Governing Law, Jurisdiction, and Severability
1. Governing Law
o These Terms shall be governed by and construed in accordance with the laws of Egypt.
2. Jurisdiction
o Disputes arising in connection with these Platform Terms (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the courts of Egypt.
3. Severability
o If any part of these Terms is deemed unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any of the remaining provisions.
o No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
Amendments
• Aklak Taza may amend these Terms at any time in its sole discretion.
• The amended Terms shall be effective immediately upon posting, subject to applicable laws.
• It is your responsibility to check the Terms regularly.
• If you do not agree with the amended Terms, whether in whole or in part, you must stop using the Platform and/or any of its services immediately.
Language Preference
• These Terms shall be available in both English and Arabic.
• In case of any discrepancies between the two versions, the English version shall prevail.
